Please read these Terms of Service ("Terms") carefully before purchasing or using any product offered by YB Techworks ("we", "us", or "our"), an independent software studio based in Kyoto, Japan. By accessing or using our products, you agree to be bound by these Terms.
1. Products and Services
YB Techworks develops and sells digital software products, including Chrome extensions, mobile applications, and web applications ("Products"). All Products are delivered digitally upon purchase.
2. License Grant
Upon purchase, we grant you a non-exclusive, non-transferable, revocable license to use the Product for personal, non-commercial purposes, subject to these Terms. You may not:
- Copy, modify, or create derivative works of the Product
- Reverse engineer, decompile, or disassemble the Product
- Sublicense, sell, rent, or transfer the Product or your license to any third party
- Remove or alter any proprietary notices or labels on the Product
3. Intellectual Property
YB Techworks retains all right, title, and interest in and to the Products, including all intellectual property rights. These Terms do not transfer any ownership rights to you. You retain ownership of any data you create or input using our Products.
4. Payment
All purchases are processed through Stripe, Inc. Prices are displayed in USD and are subject to applicable taxes. By completing a purchase, you authorize Stripe to charge your payment method for the stated amount. We reserve the right to change prices at any time; changes will not affect already-completed purchases.
Some Products (for example, Manga de Nihongo) are paid for with one-time credit packs rather than subscriptions. Credits are described in Section 5 below.
5. Credits
Products that offer credits (for example, Manga de Nihongo, where one credit translates one page) grant you a revocable license to use the Product's services as credits are applied, as described below:
- Each credit is consumed when it is used to request the service (for example, translating one page) and the service is delivered. Unused credits remain on your balance and never expire while the service is offered.
- If a service request fails and no result is delivered (for example, a translation error), the credit for that request is automatically returned to your credit balance. If a request is only partially delivered (for example, some lines of a page could not be translated), the page credit is still consumed.
- Results already cached from a prior request do not consume a credit.
- Because translations are generated by AI and provided "as-is" (see Section 6), an output you consider inaccurate is not grounds for a credit refund. If you believe a result is erroneous or the service failed, contact us and we will investigate.
- Credits have no cash value. They are a usage allowance, not stored value or a currency, and are not redeemable for money.
- Trial credits granted on sign-up are provided free of charge.
- If we terminate these Terms because you breached them, any remaining credit balance is forfeited and not refunded.
- If we discontinue a Product, we will provide reasonable advance notice; unused credits remaining at the end of the notice period are forfeited and not refunded.
- Nothing in these Terms waives statutory rights (including the right to a refund for non-conforming digital content) that cannot be waived under applicable law.
6. No Warranties
Products are provided "as-is" and "as-available" without warranties of any kind, either express or implied. We do not warrant that the Products will be error-free, uninterrupted, or free of viruses or other harmful components, or that any defects will be corrected.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- Our total liability to you for any claim arising from or related to these Terms or our Products shall not exceed the total amount paid by you to YB Techworks in the twelve (12) months preceding the claim.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.
8. Prohibited Use
You agree not to use our Products:
- For any unlawful purpose or in violation of any applicable laws or regulations
- To abuse, harass, or harm others
- To redistribute or resell our Products without authorization
- In any manner that could damage, disable, or impair our services
For Products that use artificial intelligence or machine-translation services (for example, Manga de Nihongo), you additionally agree not to:
- Use the Product as a general-purpose translation or language-model API, or for any purpose other than reading and understanding the content you are legitimately viewing
- Attempt prompt injection, jailbreaking, or otherwise attempt to extract the underlying model's instructions or make it respond outside its intended function
- Make automated, scripted, or bulk requests, or otherwise circumvent our rate limits or any technical access controls
- Submit content other than the pages you are legitimately reading
9. Subscription Cancellation
If you purchase a recurring Premium subscription (for example, ClearSight), you may cancel at any time through Stripe, using the subscription management link in your receipt email, or by contacting us. Cancellation takes effect at the end of your current billing period; you will retain access to Premium features until that date. We do not issue refunds for the unused portion of a subscription period, except where required by applicable law or as described in our Refund Policy.
One-time purchases are not subscriptions and have no cancellation option after delivery, except as described in our Refund Policy.
10. Export Restrictions
Our Products are subject to the export control laws and regulations of Japan and applicable international agreements. You agree not to export, re-export, transfer, or use our Products in violation of such laws, including use by or transfer to individuals or entities listed on applicable sanctions or denial lists, or use in countries or territories subject to comprehensive sanctions.
11. Promotions
We do not currently offer promotional discounts, coupon codes, or special offers. Any future promotions will be subject to their own terms and conditions, which will be published at the time of the promotion.
12. Termination
We may suspend or terminate your access to our Products immediately, without prior notice, if you violate these Terms. Upon termination, your license to use the Product ceases immediately.
Without limiting the foregoing, we may also suspend or terminate your access if you abuse the Product (for example, exceeding reasonable use, evading rate limits, or attempting prompt injection), in which case any remaining credits are forfeited and are not refunded.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Japan. Any dispute arising from or related to these Terms or our Products shall be subject to the exclusive jurisdiction of the Kyoto District Court, Japan.
14. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of our Products after such changes constitutes your acceptance of the revised Terms.
